| Spanish abstract | Se plantea la hipótesis de la globalización del control penal, caracterizada por la expansión del control penal que aprovecha la globalización para trascender sobre áreas determinadas por intereses de Estados centrales con influencia decisiva en la política penal internacional, lo cual posteriormente se traslada internamente e influye en los sistemas penales y políticas de seguridad locales. Las áreas donde este fenómeno ha sido observado son el control antidrogas, el terrorismo y la delincuencia organizada, dirigidos hacia un derecho penal especial, de emergencia o excepción que terminaría aglutinando la mayor parte del ejercicio del sistema penal. Dentro de este contexto, el terrorismo ofrece un valioso escenario de análisis. Tal control penal está caracterizado por el abandono del derecho penal de garantías postulado constitucionalmente y su progresiva sustitución -apoyada por tesis jurídicas y securitarias- por uno antigarantista, máximo, del enemigo y antidemocrático. La propuesta se orienta a fortalecer los mecanismos jurídico-penales garantistas que reorienten esta tendencia |
| English abstract | The hypothesis of the globalization of criminal enforcement is characterized by the expansion of crime control using globalization to transcend over specific areas determined by the interests of central states with decisive influence of international criminal policies, which is subsequently transferred internally and influences local criminal enforcement systems and security policies. The areas in which this phenomenon has been evidenced are the war on drugs, terrorism and organized crime under special criminal law for emergencies or exceptions and ultimately encompassing most of the criminal enforcement system. Within that context, terrorism offers a valuable scenario for analysis. This control is marked by a shift from criminal laws based on constitutional guarantees to a progressive substitution, grounded on legal and securitarian theses, by a system that disregards guarantees, is totalitarian, focuses on the enemy and results antidemocratic. This proposal is aimed at strengthening the legal mechanisms for the enforcement of criminal law to reorient that trend.
