Spanish abstract | El artículo sugiere que la reciente renovación en la historia del derecho y de la justicia por un lado, y de la historia política por otro, puede ser fructíferamente complementada por la reincorporación de la historia constitucional como área de estudio de los historiadores profesionales. Frecuentemente monopolizada por los juristas o historiadores del derecho de formación más tradicional, este campo de estudios ofrece una diversidad de acercamientos posibles, que en el artículo son ilustrados a través de dos temas: el papel de la justicia federal como actor político en la historia argentina, y la oscilante trayectoria del control de constitucionalidad como instrumento de protección de los derechos individuales |
English abstract | Recent innovations in legal history and the history of judicial institutions on one hand, and in Argentine political history on the other, can benefit from historians reclaiming constitutional history as an appropriate academic discipline. Constitutional history, which is usually reserved for jurists or legal historians of a traditional background, offers a myriad of possible themes in Argentine history. This piece illustrates two of these themes: the role of federal judicial institutions as a political actor, and the institution of judicial review as an instrument for the protection of individual rights |
