| Spanish abstract | Este artículo debate el equívoco diagnóstico de que el fracaso de la reforma penal y el agravamiento de la crisis de seguridad y justicia en México son, ante todo, la consecuencia del diseño legal e institucional fallido del sistema de justicia. Usando conceptos de la antropología y la sociología políticas, y por medio de una reinterpretación histórica del lugar y las funciones del sistema de justicia en el régimen autoritario, se demuestra que el colapso institucional y la incapacidad del Estado para controlar la violencia criminal son el resultado de la persistente subordinación política del sistema de justicia al Poder Ejecutivo, de su deliberada precariedad institucional y su captura por intereses privados y actores delincuenciales. La inoperancia estructural del sistema de justicia se ha reproducido en el ciclo de la transición a la democracia y se ha agravado en el contexto de un federalismo conservador constituido por regímenes autoritarios subnacionales, los cuales constituyen el principal obstáculo de una auténtica reforma de la justicia |
| English abstract | This article discusses the widespread and equivocal diagnosis that attributes the failure of the justice reform and the crisis of violence and insecurity in Mexico to the justice system’s broken institutional and legal design. Using concepts from both political sociology and anthropology, and through a historical reinterpretation of the place and functions of the justice system in the authoritarian regime, it is shown that the institutional collapse and the inability of the State to control criminal violence are the result of the persistent political subordination of the justice system to the executive power, of its deliberate institutional precariousness and its capture by private interests and criminal actors. The structural ineffectiveness of the justice system has been reproduced in the cycle of the transition to democracy, and has worsened in the context of a conservative federal arrangement constituted by subnational authoritarian regimes, which constitute the main obstacle to a genuine reform of the justice system |
