| Spanish abstract | El derecho debe ser tan dinámico como la propia sociedad, el sistema normativo debe revisarse en forma permanente y el legislador debe de realizar las adecuaciones pertinentes para que los derechos se dinamicen en términos de efectividad. Respecto de la protección del patrimonio de los adultos mayores es una prioridad revisar no sólo la armónica normatividad que ha de aplicar el juzgador, ya que en el diario quehacer jurisdiccional se perciben las más variadas acciones que ejercen fundamentalmente familiares para despojar de sus bienes a los adultos mayores, sin que ellos reciban beneficios directos. Se toma como ejemplo el Estado de México ya que su situación geopolítica y demográfica permite considerar que representa la suma y síntesis de la problemática que en materia de protección del patrimonio de adultos mayores se vive en la República Mexicana |
| English abstract | The law must be as dynamic as society itself, the regulatory system must be reviewed on a permanent basis and the legislator must make the necessary adjustments so that the rights are dynamic in terms of effectiveness. With respect to the protection of the heritage of older adults, it is a priority to review not only the harmonious regulations that the judge has to apply, since in the daily judicial work the most varied actions are perceived, exercised by relatives to strip away older adults of their possessions, without them receiving direct benefits. This work is conducted, under the self-experience of judges of the State of Mexico, a revision to the tendency that is lived regarding the protection of the patrimony of older adults. It is done in this entity since its geopolitical and demographic situation allows to consider the sum and synthesis of the problematic that is lived in the Mexican Republic |
