| Spanish abstract | Un acuerdo humanitario en medio del conflicto interno se puede realizar sin necesidad de la expedición de una ley de canje, ni siquiera invocando la vigencia de la ley de orden público; no se necesita invocar indultos, amnistías, perdones especiales, derecho de gracia; sin necesidad de armisticio, vigencia de un estado de excepción u otro adminículo jurídico. Un acuerdo humanitario puede hacerse así no exista proceso de paz, pero puede convertirse en el mejor gesto para iniciar un nuevo proceso de paz, o al menos para acercarse las partes (gobierno y guerrilla) a discutir una agenda nueva; en fin, para distensionar el clima de violencia |
| English abstract | An humanitarian agreement in the midst of the domestic conflict, can be achieved without the passing of a law of exchange of prisoners, even without invoking for a public order law to be inforced. Indults, amnesty, special forgiveness, an state of exception or other judicial tools, are not necessary. An humanitarian agreement could be subscribed even though there is no peace process, but it could turn into the best gesture in order to give a start to a new peace process, or at least to make the two parts approach each other (government and guerrilla) to discuss a new agenda; in short, to make less tense the climate of violence |
