| English abstract | The following article aims to analyze the Ecuadorian legislation on the crime of slander against the right to honor and good name of citizens. For this, a descriptive study of type bibliographic review was carried out; systematized through scientific research methods: historical-logical. On this basis, it was necessary to use methods such as exegetical and analytical-synthetic. At the same time, was used the content analysis" technique. The foregoing allowed us to obtain the results that imply that in Ecuador there is a legal framework that systematizes the right to honor and good name of citizens. For this reason, article 56 number 2 of the Organic Integrated Process Code (COGEP), provides for the use of mass media for the citation of judicial processes. This, checks out the image of the same for the consideration of the insult as a violation and not as a crime typified by law and criminally understood as a legal vacuum. |
| Spanish abstract | El siguiente artículo tiene como objetivo el análisis de la legislación ecuatoriana sobre delito de calumnia contra el derecho al honor y buen nombre de los ciudadanos. Para ello, se realizó un estudio descriptivo de tipo revisión bibliográfica; sistematizado a través de los métodos de investigación científica: histórico-lógico. Sobre esta base, fue necesario la utilización de métodos como exegético y analítico-sintético. Además, de la técnica de análisis de contenido. Lo anterior, nos permitió obtener los resultados que implican que en Ecuador existe un marco legal que sistematiza el derecho al honor y buen nombre de los ciudadanos. Por ello, el artículo 56 numeral 2 del Código Orgánico Integral de Procesos (COGEP), dispone el empleo de los medios de comunicación masivos para la citación a los procesos judiciales. Esto, desprotege la imagen del mismo por la consideración de la injuria como contravención y no como delito tipificado jurídica y penalmente entendido como un vacío legal. |
