| Spanish abstract | El presente trabajo tiene como objeto analizar la responsabilidad penal del empresario en España, desde la óptica del principio de legalidad y de la interpretación que se da a las distintas normas aplicables al caso concreto, a partir del examen de una sentencia del Tribunal Constitucional español en la que se aborda la aplicación in malam partem del principio y de cómo el órgano constitucional decide la cuestión aplicando normas que al tiempo del juicio no existían, pasando a llevar a nuestro entender no solo el mencionado principio sino que decisiones de otros órganos que ejercen verdadera jurisdicción, como el Tribunal Supremo español |
| English abstract | The purpose of this paper is analyze the criminal liability of the businessman in Spain, from the point of view of the principle of legality and the interpretation given to the different rules applicable to the specific case, based on the examination of a sentence of the Constitutional Court of Spain, in which addresses the application in malam partem of the principle and how the constitutional body decides the issue by applying rules that at the time of the trial did not exist, moving to our understanding not only the aforementioned principle but decisions of other bodies that exercise true jurisdiction as the Supreme Court of Spain |
