| Spanish abstract | La idea de justicia es una de las constantes a lo largo de la historia de la humanidad, no obstante, este concepto, por su abstracción, es tal vez una de las eternas preguntas que seguirán existiendo, sin embargo, en la vida de cualquier sociedad es un tema presente aun cuando su definición sea una tarea compleja. En ese sentido, la justicia y el derecho han encontrado una relación inseparable, por lo cual, dentro de las diferentes concepciones del derecho se contempla a la justicia de uno u otro modo, asimismo, en tanto que éstas se encuentran orientadas a mantener el orden social, es también necesario conocer lo que implican y así acercarse un poco más al concepto de justicia. Finalmente, en tanto que el derecho (justo) está encaminado a sostener el orden, crea una serie de normas jurídicas las cuales, como sistema, dotan de certeza a todas y todos los ciudadanos respecto de las consecuencias de sus actos, esto es, lo que actualmente conocemos como seguridad jurídica. Es así que, en el estudio de cualquier sociedad, aun en aquellas cuyos sistemas jurídicos se encuentran menos desarrollados, se pueden observar estos tres conceptos: justicia, orden social y seguridad jurídica, por lo que son temas de estudio obligados para poder entender la manera en la cual se funda la sociedad y su sistema jurídico |
| English abstract | The idea of justice has been present in the history of humankind even though its definition is a difficult goal to reach out. In fact, justice and law have found an inseparable relationship. Therefore, within the different conceptions of law, justice is contemplated in one way or another, as well, while both are oriented to keep social order, it is also necessary to know what does it implies and thus approach a little more to the concept of justice. Finally, while the law (law is aimed at sustaining order) creates a series of legal norms which, as a system, provide certainty for all citizens regarding the consequences of their actions; the so-called legal certainty. Thus, in the study of any society, even those whose legal systems are less developed, you can see these three concepts: justice, social order and legal certainty, so they are subjects of study required to understand the way society and its legal system are founded |
