| English abstract | Criminal mediation as an element of restorative justice for young offenders remains under the control of the Judiciary Council, which limits its applicability and reduces its scope. The objective is to evaluate the application of penal mediation as an instrument of restorative justice in young adolescent offenders by analyzing the current legal regulation in Ecuador. A descriptive-interpretative documentary study was conducted. Theoretical perspectives and data and figures provided by the National Council of the Judiciary were addressed. Among the main results is the establishment of penal mediation as a great tool of restorative justice, and the recommendation to amplify its use in order to decongest the Ecuadorian penal system for adolescent offenders. It is concluded by indicating that there is a need to continuously implement mediation as a strategy in the justice system, because it promotes restorative, peaceful conflict resolution and contributes to the welfare of the young people involved. |
| Spanish abstract | La mediación penal como elemento de la justicia restaurativa para jóvenes infractores se mantiene bajo el control del Consejo de la Judicatura lo que limita su aplicabilidad y reduce su alcance. El objetivo es evaluar la aplicación de la mediación penal como instrumento de justicia restaurativa en jóvenes adolescentes infractores haciendo un análisis acerca de la regulación legal vigente en Ecuador. Se realizó un estudio documental descriptivo-interpretativo. Donde se abordaron perspectivas teóricas y los datos y cifras otorgadas por el Consejo Nacional de la Judicatura. Entre los principales resultados resalta el establecimiento de la mediación penal como una gran herramienta de la justicia restaurativa, y la recomendación de amplificar su uso con el fin de descongestionar el sistema penal ecuatoriano en materia de adolescentes infractores. Se concluye indicando que existe la necesidad de implementar continuamente la mediación como una estrategia en el sistema de justicia, porque fomenta la restauración, resolución pacífica de conflictos y contribuye al bienestar de los jóvenes involucrados. |
