| English abstract | The mediation in the family constitutes a pillar within the justice system, the resolution of the conflict finds a door to harmonize the confrontations that occur within the family nucleus. The objective of this study is to analyze the resolutions issued by the Plenary of the Judiciary Council to achieve family mediation in Ecuador. A documental, observational, cross-sectional study was carried out under a descriptive analysis, using the analytical-deductive method. A registration instrument was designed to analyze the resolutions issued by the Judiciary Council of Ecuador. Within the results it could be seen that since 2014 family cases have been increasing in the use of the mediation resource with 53.03% by 2020. To conclude, it is concluded that mediation in the family constitutes an advance to decongest the justice system, however, there are more petitions than resources processed by the national centers of arbitration and mediation. |
| Spanish abstract | La mediación en la familia constituye un pilar dentro del sistema de justicia, la resolución del conflicto encuentra una puerta para armonizar los enfrentamientos que se producen dentro del núcleo familiar. El estudio plantea como objetivo analizar las resoluciones dispuestas del Pleno del Consejo de la Judicatura para alcanzar la mediación de familia en Ecuador. Se realizó un estudio documental, observacional, de corte trasversal bajo el análisis descriptivo, usando el método analítico-deductivo. Se diseñó un instrumento de registro para analizar las resoluciones emitidas por el consejo de Judicatura del Ecuador. Dentro de los resultados se pudo constatar que desde el 2014 los casos familiares han ido en aumento en el uso del recurso de la mediación con un 53,03% para el 2020. Para finalizar se concluye que la mediación en la familia constituye un avance para descongestionar el sistema de justicia, sin embargo, son más las peticiones que los recursos procesados por los centros nacionales de arbitraje y mediación. |
