| English abstract | With the passing of time, the family has evolved, taking different forms, among them the single-parent family composed of a single parent and his/her child(ren). This article evaluates if the norms applied to the figure of adoption of minors in the state of Guerrero in Mexico are inclusive of the single-parent family, in observance of the prevalence of the interest of the child and its Fundamental Rights, under an inclusive model that contemplates all the existing family forms; since the legal systems of the Mexican federal entities must tend towards equality and inclusion. A legal research of evaluative level of analytical prototype was developed, carried out with the hypothetical deductive method and under the qualitative research paradigm. As a result, it was observed that there is no match between the existing regulations and the fundamental rights of the subjects of adoption; furthermore, proposals for regulatory adaptation are made. |
| Spanish abstract | Con el transcurrir del tiempo, la familia ha evolucionado, conformándose de maneras diversas, entre ellas la familia monoparental compuesta por un solo progenitor y su(s) hijo (s). En este artículo se evalúa si las normas aplicadas a la figura de la adopción de menores en el estado de Guerrero en México son inclusivas de la familia monoparental, en observancia de la prevalencia del interés del niño y sus Derechos Fundamentales, bajo un modelo inclusivo que contemple todas las formas de familia que existen; pues los sistemas jurídicos de las entidades federativas mexicanas deben propender por la igualdad e inclusión. Se desarrolló una investigación jurídica de nivel evaluativo de prototipo analítico, realizada con el método hipotético deductivo y bajo el paradigma cualitativo de investigación. Como resultados se observó que no existe aparejamiento entre la normatividad existente y los derechos fundamentales de los sujetos de adopción, además se plantean propuestas de adecuación normativa. |
