| Spanish abstract | El presente artículo desarrolla las materias susceptibles de arbitraje en la legislación nacional vigente (Decreto Legislativo N° 1071), sin dejar de citar la doctrina y derecho comparado tanto desde un criterio positivo como desde el criterio negativo que la normatividad anterior destacaba. Cabe resaltar el análisis que el artículo desarrolla sobre la doctrina del estoppel y la teoría de los actos propios en materia del arbitraje, así como los conflictos que afectan a la familia tanto de naturaleza extrapatrimonial como patrimonial en el ámbito del matrimonio, la vejez y la sucesión |
| English abstract | This paper develops the matters subject to legal arbitration under the current legal national system (Legislative Decree N° 1071), without leaving aside the doctrine and the compared law from both a positive and negative criteria highlighted by the prior regulation. The analysis developed by this paper on the estoppel doctrine and own acts theory related to arbitration, as well as the conflicts affecting the family both of non-economic and economic nature regarding the marriage, old age and succession, should be emphasized |
