| Spanish abstract | En este artículo el autor analiza la regulación de la acción contencioso administrativa en la Constitución Política del Perú de 1993, que establece en su artículo 148° lo siguiente: “Las resoluciones administrativas que causan estado son susceptibles de impugnación mediante la acción contencioso-administrativa”; teniendo en consideración las instituciones utilizadas en su contenido como son: “resoluciones administrativas”, “causa estado” e “impugnación”; términos que generan confusión al momento de interponer la demanda ante el Poder Judicial, que debido a la evolución de sus conceptos, deben de ser modificados. Es por ello, que con el presente trabajo se pretende advertir las consecuencias negativas que conlleva la fórmula normativa constitucional utilizada en la Carta Magna de 1993 |
| English abstract | In this article the author analyzes the regulation of contentious administrative action in the 1993 Political Constitution of Peru, which establishes in its article 148° the following: “Administrative resolutions that cause status are subject to challenge through contentious-administrative action” ; taking into consideration the institutions used in its content, such as: “administrative resolutions”, “state cause” and “challenge”; Terms that generate confusion at the time of filing the claim before the Judicial Power, which due to the evolution of its concepts, must be modified.
