| Spanish abstract | En el presente artículo, el autor se plantea el tema que es materia de controversia, de si el Título Preliminar en la codificación civil es una simple tradición mantenida por los juristas codificadores, o si realmente tiene una función relevante y trascendente. El autor es de opinión que sí la tiene, pues sus normas, con relativa frecuencia, han servido para integrar vacíos de las normativas constitucionales, como puede comprobarse en los Títulos Preliminares de nuestros Códigos Civiles de 1852, 1936 y 1984, que fueron promulgados durante la vigencia de las Constituciones de 1839, 1933 y 1979, respectivamente |
| English abstract | In this article, the author poses a theme that is the subject-matter of if the Preliminary Title in the Civil Codification is a simple tradition kept by the jurist coders or if it really has a relevant and transcendent function. The author considers that, yes, it has it, for its regulations, with a relative frequency, have served to embed the gap in the constitutional provisions; as it can be evidenced in the Preliminary Titles of our Civil Code of 1852, 1936 and 1984, which were promulgated during the Constitutions of 1839, 1933 and 1979, respectively |
