| Spanish abstract | El presente artículo refleja un análisis de la deslegitimación democrática del Derecho de que ha sido objeto cuando se basa esencialmente como un producto político. Enuncia las posiciones teóricas que a través de la historia del pensamiento jurídico-político han soportado el argumento de que el Derecho producido por los cuerpos de representación política está plenamente legitimado. Así también en la parte final, se exponen la falta de legitimación del Derecho, cuando éste no cuenta con un válido respaldo social, que le daría una verdadera legitimación |
| English abstract | This article reflects an analysis of the democratic legitimization of law, which has been essentially based like a political product. Sets out the theoretical positions that through the history of political and legal thoughts have supported the argument that the law produced by the bodies of political representation is fully legitimized. The same way at the end of the article, it reveals the lack of validity of the law, when this has no real social support, which would give a real legitimacy |
