| English abstract | The Forensic Medicine, as scientific expertise placed at the service of Law and Justice, has traveled a long and arduous journey to solidify and be recognized for their importance. The analysis of its trajectory History demonstrates its legal significance, making the researcher, albeit in front turned to the past, absorb its valuation and its evaluation. Besides the knowledge History, it is important for the student of the laws that he understands the role of science in the service of law and in the case of this study that adds to his repertoire in order that the law confers on medico-legal examinations. The purpose of this research is to analyze the importance of expertise as evidence in elucidation of the facts related to the dispute, and in particular point out the relevance of medical and legal experts in clarifying the facts complained of, stressing the search for truth in the real Criminal Procedure in the light of current Brazilian legislation |
| Portuguese abstract | A Medicina Legal, como especialização científica posta a serviço do Direito e da Justiça, percorreu longo e árduo percurso até se solidificar e ser reconhecida a sua importância. A análise de sua trajetória Histórica demonstra a sua relevância jurídica, fazendo com que o pesquisador, ainda que de fronte voltada ao passado, absorva sua valorização e sua valoração. Além do conhecimento Histórico, é importante para o estudioso das Leis que este compreenda a função das Ciências a serviço do Direito e, no caso do presente estudo, que acrescente a seu repertório o objetivo que o Direito confere aos exames médico-legais. O escopo desta pesquisa é analisar a importância da perícia como meio de prova para elucidação dos fatos correlatos à lide, e, em especial, apontar a relevância da perícia médico-legal no esclarecimento dos fatos imputados ao acusado, frisando a busca da verdade real no Processo Penal à luz da legislação brasileira vigente |
