| Spanish abstract | Presentar una definición sobre la tortura, establecer los elementos jurídicos constitutivos y distinguirlo con otras conductas, no ha sido tarea fácil. Este esfuerzo fue asumido por los organismos internacionales de derechos humanos, obteniéndose como resultado una importante labor jurisprudencial, que ha fundamentado los instrumentos internacionales existentes en la materia. La prohibición de practicarla ha sido elevada a Jus Conges, ubicándolo dentro del llamado núcleo inderogable. Al distinguirla con los tratos inhumanos y degradantes, las evaluaciones dependerán de las circunstancias específicas de cada caso. Posee algunos parámetros de medición y tiene carácter evolutivo en pro a la defensa de los Derechos Humanos |
| English abstract | Presenting a definition of torture, establish legal constituent elements and distinguish with other behaviors, has not been easy. This effort was undertaken by the international human rights bodies, which resulted in an important work of jurisprudence, which has substantiated the existing international instruments in this field. The prohibition of practice has been elevated to Jus Conger, located within the so-called core derogable. To distinguish the inhuman and degrading treatment, assessments depend on the specific circumstances of each case. It has some benchmarks for measuring and evolving nature for the defense of human rights |
