| Spanish abstract | Este artículo trata de superar la incertidumbre que se presenta frente a los derechos humanos. Para ello se analizan algunas teorías del derecho que muestran la naturaleza fi losófi ca y jurídica en torno a la controversia de éstos. En segundo lugar se realiza una lectura al utilitarismo, y el liberalismo para establecer las necesidades básicas que requieren los individuos dentro de una sociedad democrática. Al fi nal se plantea una inquietud que genera escepticismo sobre la efi cacia de los derechos humanos, debido a la sociedad pluralista que existe en los tiempos contemporáneos |
| English abstract | This article tries to overcome the uncertainty concerning human rights. For this purpose some law theories that show the philosophical and legal nature surrounding the controversy on human rights are analyzed. Secondly, a reading on Utilitarianism and Liberalism was done in order to establish the basic needs that individuals require within a democratic society. At the end, a query that generates skepticism on the effi ciency of human rights is proposed, due to the pluralist society that presently exists |
