| Spanish abstract | Un Estado es la justificación interna de un poder orgánicamente elevado por encima de los asociados. Dicha justificación interna debe incluir pautas normativas morales vinculantes entre el mandato y la adhesión, que se materializan en los actos de prometer garantías. Estas pautas encuentran su naturaleza, en la mayoría de los casos, bajo estructuras de actos de habla performativos, los cuales realizan el contenido proposicional con su sola enunciación. Los performativos requieren para su validez de determinadas condiciones que acarrean lo infortunado o afortunado, lo sincero o insincero de dicho acto. En este punto, el argumento de la pretensión de corrección del derecho da los elementos que, basados en estructuras performativas, desencadenan fallas clasifi catorias y cualifi catorias e introducen la idea de legitimidad. Así, dadas ciertas omisiones y perfi dias de la realidad, los sistemas jurídicos y políticos que no cumplan con las condiciones mencionadas adquieren la categoría de ilegítimos y, por ende, pierden su razón de ser |
| English abstract | A state is the internal justification of an organically elevated power over the associates. Said internal justifi cation must include moral and entailing guidelines between the order and the adhesion that materialize in acts of promising guarantees.These guidelines fi nd their nature, in most cases, under structures of performative speech acts. These acts emphasize the propositional content just by enunciating them. The performative acts require, for their validity, certain conditions that bring about fortunate or unfortunate, sincere or insincere of said act. At this point, the pretension of law correction results in the elements that based on performative structures unchains classifi cation and qualifi cation mistakes, and introduces the idea of legitimacy. Given certain omissions and treacheries of reality, legal and political systems that not accomplish the above mentioned conditions, acquire the classifi cation of illegitimate and, therefore, lose their reason for being |
