| Spanish abstract | El derecho al acceso a la justicia se ha convertido en uno de los más importantes derechos consagrados en la Constitución Política, especialmente para los sectores sociales que carecen de recursos económicos para acceder a los estrados judiciales en busca de justicia. En el departamento de Caldas, el acceso a la justicia impartida por los jueces de la república tiene una importante representatividad social en tanto es bien evaluada por usuarios y por abogados, lo que tiene una significación grande para la institucionalidad y legitimidad del estado en esta región del país. No obstante, hay barreras constantes que permanecen en el tiempo y en el espacio para el acceso a la justicia como son las desigualdades económicas, sociales y culturales de los diferentes usuarios de la justicia; las financieras, es decir los costos de los honorarios profesionales, costas judiciales y desplazamiento a los despachos; el excesivo formalismo de los jueces y funcionarios judiciales incidiendo directamente en la demora de los procesos; el tiempo que tarda en resolverse un litigio en los estrados judiciales, siendo el departamento de Caldas donde menos se demora el trámite de un proceso y las deficiencias en la organización de los despachos que inciden directamente en las anteriores |
| English abstract | The right to justice access has become one of most important rights included in the Political Constitution, specially for those sectors of society that don’t possess the economic conditions to access the judicial courts in search of justice. In the department of Caldas the access to justice imparted by the judges of the republic has an important social representativeness, since it is well evaluated by users and by lawyers, which has a great meaning for the institutionality and legitimacy of the state in this part of Colombia. In spite of the latter, there are constant barriers that last in time and space for the access to justice such as economical, social and cultural inequalities of the different justice users. The financial barrier, that is to say, the judicial costs of the professional honoraries, judicial coasts and travels. The excessive formalism of the judges and judicial employees is another barrier that directly affects the delay of the processes. The time taken in solving a litigation in the judicial courts in yet another barrier, being the department of Caldas the place where the proceeding of a process is less delayed, as well as the deficiencies in the organization of the offices that affect the previous barriers |
