Spanish abstract | Este trabajo presenta dos argumentos fundamentales: 1) que la teoría estándar de la regulación económica basada en la noción de fallo del mercado (TSR) es sistémica y normativamente insatisfactoria y 2) que la noción de interés general es una idea central para construir una teoría de la regulación del mercado sólida e incluyente. La TSR es sistémicamente débil en tanto que no permite dar cuenta de manera coherente de las distintas justificaciones para la intervención regulativa (p. ej., la oposición entre regulación económica y regulación social) y es normativamente deficiente por que resulta incapaz de fundamentar la actividad regulativa en principios normativos fuertes, i.e., es incapaz de reconciliar dentro de la teoría los objetivos de eficiencia y justicia. Utilizar la noción de interés general como base de una teoría de la regulación permite definir la regulación como la actividad social que estructura los intercambios voluntarios. Al hacer esto, nos centramos en la identidad social y normativa de los mercados, sin tener que asumir presupuestos metodológicos (p. ej., equilibrio competitivo, racionalidad, información perfecta) o metafísicos (p. ej., el bienestar social) |
English abstract | The main claims of this paper are 1) that standard market failure theories (MFT) of economic regulation is both systemically and normatively weak and 2) that the notion of general interest is a pivotal idea for the construction of a strong and inclusive theory of market regulation. MFT is systemically weak in that it fails to give account of the conflicting rationale for market regulation (e.g. economic regulation vs. social regulation) and is normatively feeble because it is unable to ground the regulatory activity on strong normative principles, i.e. reconciling efficiency and justice goals within the theory.
