| Spanish abstract | La historia de la Nueva Granada anterior a la revolución de independencia es usualmente calificada como una etapa en la que reinó el despotismo y la injusticia. Este artículo muestra, por el contrario, cómo la Corona española logró poner en pie un eficaz conjunto de normas, instituciones y consensos destinados a garantizar la convivencia. Pero el texto no se concentra en la administración de justicia sino en comprender la manera cómo fue concebida la ley, y sobre todo la justicia, en la sociedad monárquica neogranadina. Indaga acerca de los rasgos centrales de la justicia, cuáles fueron sus fundamentos y de qué fuente se originaban, resaltando el rol del monarca, no solo como juez supremo, sino también como arquetipo de lo justo |
| English abstract | The history of New Granada previous to the independence revolution is usually described as a stage where despotism and injustice reigned. This article shows, on the contrary, how the Spanish Crown managed to put in place an effective set of rules, institutions and consensus aimed at guaranteeing coexistence. But the text does not concentrate on the administration of justice but on understanding the way in which the law was conceived, and especially justice, in the monarchical society of New Granada. It inquires about the central features of justice, what were its foundations and from what source they originated, highlighting the role of the monarch, not only as supreme judge but also as an archetype of the just |
