| Spanish abstract | Situados en la intersección entre las representaciones satírico visuales y los marcos normativos en torno a la libertad de imprenta entre 1868 y 1883, este trabajo reflexiona sobre la dinámica periodística en su relación con la política. Para ello se estudian las caricaturas generadas en esta etapa, así como las leyes y diversas disposiciones oficiales -reglamentos, reformas constitucionales, decretos, circulares, entre otros-. Las tensiones suscitadas entre el mundo de la prensa y las autoridades gubernamentales son también debidamente recuperadas en estas páginas, con el fin de mostrar la complejidad del tema, la diversidad de actores que intervinieron en el proceso, las múltiples aristas que presenta, las varias perspectivas desde las cuales puede ser abordado, superando así la tradicional visión dicotómica: gobierno represor, prensa independiente. Facultades extraordinarias, suspensión de garantías, leyes de imprenta, reforma del artículo séptimo constitucional, estrategias de censura, tanto legales como extralegales, así como mecanismos de represión -formales e informales-, algunos de ellos marcados por el uso de la violencia física, son puestos bajo la lupa con la finalidad de entender los debates y los sucesos desarrollados en torno a la defensa y ataque de la libertad de prensa en la búsqueda por regular y acotar los márgenes de expresión. El papel que desempeñan los poderes ejecutivo, legislativo y judicial en estas dinámicas, son también motivo de estudio y análisis del presente artículo. Incluye el trabajo un par de anexos en los que se da cuenta puntual de las leyes y disposiciones vigentes en cada momento, así como del devenir de la reforma constitucional del artículo séptimo, información que antes no se había sistematizado y que resulta fundamental para entender el contexto legal sobre la libertad de imprenta |
| English abstract | Situated in the intersection between satirical visual representations and the regulatory framework on the freedom of the press between 1868 and 1883, this article reflects on the dynamic relationship between journalism and politics, studying the political cartoons published during this period, as well as laws and various legal provisions - regulations, constitutional reforms, decrees, circulars, etc. The tensions between the press and government authorities are duly studied herein with the goal of showing the complexity of the issue, the diversity of actors that intervened in this process, the many difficulties it presents and the varied perspectives from which it can be addressed, thus overcoming the traditional dichotomous vision of repressive government/independent press. Extraordinary powers, the suspension of guarantees, press laws, the reform of Article 7 of the Constitution, censorship strategies (both legal and extralegal) and mechanisms of repression (both formal and informal, some of them marked by the use of physical violence) are examined in order to understand debates and developments in the defense of and attack on the freedom of the press as part of the search to regulate and delimit the margins of expression. The roles played by the executive, legislative and judicial branches in these dynamics are also studied and analyzed in this article. The appendices include a chronological account of the laws and legal provisions in place at each time, as well as of the reform of Article 7 of the Constitution; this information has never before been systematized, yet it is essential to understanding the legal context for the freedom of the press |
