| Spanish abstract | El presente estudio tiene por objeto describir la evolución constitucional a partir de la cual se construye el nuevo derecho mexicano. Dicha construcción es consecuencia del binomio entre el principio de igualdad y el modelo neo-constitucional, circunstancia que se refleja en el sentido de las resoluciones a cargo del Poder Judicial Federal en la interpretación de la norma fundamental. A partir de ello, se comprueba la tesis de que las normas de derecho fundamental en el paradigma nacional, son ante todo, normas de principio, confirmadas, en primer lugar, mediante la incorporación de la moral y la función interpretativa y, en segundo, en la aplicación del principio de la igualdad como parámetro de dicha interpretación constitucional |
| English abstract | The present study, was intended to describe the constitutional evolution from which builds the new Mexican law. This construction is the result of the duality between the principle of equality before the law and the constitutional model neo, a circumstance that reflects the sense of the resolutions in charge of the Federal Judiciary in the interpretation of the fundamental rule. From this, checked the thesis that the fundamental rules of law in the national paradigm, are first and foremost rules of principle, confirmed in the first place by the incorporation of the moral in the interpretative function and, secondly, in the application of the principle of equality as parameter of that constitutional interpretation |
