| Spanish abstract | Este escrito trabaja los temas de la seguridad jurídica y la tutela contra sentencias. Pretende mostrar dos cosas: en primer lugar, que el Estado de inseguridad jurídica que padece Colombia no tiene origen en las sentencias que profieren los jueces de tutela, sino en las prácticas normativas irregulares del Congreso y de la Presidencia de la República. En segundo lugar evidencia, desde las prácticas del Sistema Interamericano de Protección de los Derechos Humanos, del que Colombia forma parte y, que resulta conforme con la Convención Americana sobre Derechos Humanos, el examen judicial de las sentencias proferidas por los jueces locales |
| English abstract | This article works with the themes of judicial security and the tutela action against decisions. It seeks to demonstrate two things: the first is that judicial insecurity that seems to occur in Colombia does not have its origins in the decisions emanating from the tutela deciding judges, but in the irregular normative practices of the Congress and the Presidency of the Republic. The second is to examine decisions issued by local judges, from the point of view of the practices of the Inter-American System for the Protection of Human Rights, of which Colombia forms a part and to which, as a result, conforms itself to the American Convention on Human Rights |
