Spanish abstract | Este ensayo demuestra, desde una perspectiva constitucional, la forma como tanto el Congreso de la República de Colombia como el gobierno nacional pretendían eludir el control de constitucionalidad por parte de la Corte Constitucional, de textos normativos de contenido estatutario que expiden organismos estatales no democráticos, habilitados para ese fin a través de actos legislativos. Se analiza también la técnica de la regulación supletiva con base en la cual se profieren dichas normas, precisando las dos posibles vías para su control de constitucionalidad, y finalmente se reseñan los fundamentos que permiten a la Corte Constitucional asumir la revisión oficiosa de constitucionalidad de esos preceptos |
English abstract | This essay demonstrates, from a constitutional perspective, how both the Colombian Congress and the national government have sought to avoid the constitutional control of the Constitutional Court over statutory normative texts enacted by non-democratic institutions by means of powers granted by legislatives acts. The article also analyses the scope of the substitute regulation technique that allows the adoption of those statutory rules, the two possible means of their constitutional control and finally presents the reasons that give to the Constitutional Court the competence to officially review those normative decisions |
