| Spanish abstract | social relacionada a la maternidad y a la conciliación entre trabajo y familia, un campo de disputas simbólicas de gran actualidad. Así, se analiza la ley del Fuero Maternal en tanto intervención sociopolítica resultando de la evolución histórica del Estado chileno, del mercado laboral y de la condición femenina. Por una parte, aparece que el mundo privado experimenta profundas transformaciones guiadas por el concepto de igualdad de oportunidades y la desintitucionalización progresiva de la familia. Por otra parte, el rol del Estado en la regulación social es cada vez más cuestionado en un periodo permeable a los principios del neoliberalismo económico a favor de la libertad individual y de la omnipotencia del mercado económico. El ensayo se articula en dos partes. En la primera, relacionamos la evolución de las políticas sociales en América Latina con la temática de género, contextualizada en la perspectiva familiar. La segunda parte del ensayo permite analizar la Ley del Fuero Maternal con el enfoque paradigmático desarrollado por Javier Corvalán (1996). Veremos que esta ley se inscribe en el paradigma competitivo y que constituye una herramienta política para realizar un proyecto específico de modernización. Tal propuesta de análisis se ejemplifica con el resumen de un debate público que tuvo lugar en 2003 respecto de la flexibilización del Fuero Maternal |
| English abstract | This article examines a case of social intervention related to maternity and the conciliation between work and family, a prominent issue of symbolic conflict at present. The Act on Maternal Rights in Chile is reviewed as a case in the historical evolution of the State, the labor market and the gender condition. On the one hand profound changes have appeared in the private sphere, induced by the concept of equality of opportunities and by the progressive de-institutionalization of the family. On the other hand the role of the State in social regulation in being questioned from the side of neo-liberal economics in favor of the liberty of individuals and the dominance of the market. The first part of this essay looks at the evolution of social policies in Latin America from a gender perspective in the context of the family. The second part analyzes the Maternal Rights Act resting on the approach developed by Javier Corvalán (1966). The law is framed in the paradigm of competitiveness and, as such, is a political tool for implementing a specific modernization project. An example that illustrates the analysis is the public debate that took place in 2003, on the flexibility of Maternal Rights |
