| Spanish abstract | La televisión digital es un avance tecnológico al que Chile, tarde o temprano, se sumará. La tecnología digital traerá una mejor calidad de imagen y sonido, abrirá nuevas oportunidades de negocios en torno a la televisión y permitirá aumentar la eficiencia con que se usa el espectro radioeléctrico. Este artículo propone un camino regulatorio para digitalizar la televisión y aprovechar estas oportunidades. Para esto, revisa la forma en que se ha regulado la radiodifusión en general y la radiodifusión televisiva en particular. Luego, y a la luz de esa revisión, describe el escenario en que ha de transitarse a la digitalización. Entre otras cosas, este escenario se caracteriza por un régimen diferenciado de concesiones televisivas: unas son indefinidas en el tiempo, otras son temporales. Este régimen diferenciado es un problema si se quiere aprovechar al máximo las oportunidades de la digitalización. El artículo concluye sugiriendo una forma de resolver este problema a partir de la pregunta: ¿Cuál es el derecho adquirido de las concesionarias televisivas? |
| English abstract | Digital television broadcasting is a technological advance that will be embraced by Chile sooner or later. Digital technology brings with it a better quality of image and sound, it opens up new opportunities for business in television broadcasting, and it will increase the efficiency with which the radio spectrum is used. This article proposes a regulatory path to digitalize television broadcasting and take advantage of these opportunities. It looks at the way in which broadcasting has been regulated in general and television broadcasting in particular. Then, in light of that analysis, it describes the scenario in which the move towards digitalization must be made. Among other things, this scenario is characterized by a differentiated television broadcasting licensing regime: some licenses are indefinite and others are temporary. This differentiated regime poses a problem if the intent is to make utmost use of digitalization opportunities. The article suggests a way of resolving this problem by asking: what is the right of television broadcasting licensees? |
