| Spanish abstract | El presente trabajo estudia el tratamiento que la doctrina y jurisprudencia chilena le ha dado a un supuesto de expropiación: la privación de atributos y facultades esenciales del dominio. Como se argumentará, la mayor parte de la escasa doctrina que ha analizado este tema en específico, así como una parte para nada despreciable de la jurisprudencia que se ha pronunciado sobre ella, le han otorgado una interpretación expansiva. El trabajo critica esta interpretación porque desvirtúa el texto de la disposición constitucional específica, a la vez que torna difícil determinar los supuestos en que se puede utilizar la potestad configuradora de la propiedad privada que la Constitución le ha otorgado explícitamente al legislador |
| English abstract | This paper studies how Chilean Constitutional Law texts and Constitutional Court’s rulings have dealt with a hypothesis of takings that the Constitution acknowledges: the deprivation of essential attributions and powers that the Civil Law tradition usually associates to ownership. The paper argues that the greater part of the scarce Constitutional Law texts that have dealt with this matter, as has done a non-negligible part of the Constitutional Court’s rulings that have engaged the meaning of this provision. The article criticizes this interpretation on the grounds that it cannot be reconciled with the text of the specific constitutional provision, and also because it makes it very difficult to determine those cases in which the legislator can use its constitutional power to regulate private property |
