| English abstract | The present work aims to analyze the adoption of affirmative action in the Brazilian educational system as a mechanism for achieving the fundamental social right to education. Discusses the development of education as a human right, both nationally and internationally, and subsequent positivization this right on the national scene, giving the fundamental character of the right to education. To do so, to listing the right to education as a fundamental right to require the legislature and the administrator infra paternal adoption of public policies clearly defined and effective for the present embodiment |
| Portuguese abstract | O presente trabalho tem por objetivo analisar a adoção das ações afirmativas no sistema de ensino brasileiro como mecanismo de concretização do direito fundamental social à educação. Aborda o desenvolvimento da educação como direito humano, tanto em âmbito nacional quanto internacional, e a consequente positivação deste direito no cenário nacional, conferindo caráter fundamental ao direito à educação. Para tanto, ao elencar o direito à educação como direito fundamental, exige-se do legislador infraconstitucional e do administrador pátrio a adoção de políticas públicas claramente delineadas e eficazes, para a presente consubstanciação |
