| English abstract | The present work aims to analyze the application of fundamental rights and guarantees in case tried by a Brazilian court. To develop the theme, the research highlights the merits of the case law that deals with the protection of the fundamental right to accessibility. It begins by general approach of the theory of fundamental rights, going after the highlight of the court decision, the specific study about the identification, application, concept and classification of the fundamental right to accessibility as well as its legal regulation. At the end, the conclusion presents a summary of the topic if the court commenting on approach promoted proper protection of fundamental rights of the parties involved |
| Portuguese abstract | O presente trabalho tem como propósito analisar a aplicação dos direitos e garantias fundamentais em um caso concreto julgado por tribunal brasileiro. Para o desenvolvimento do tema, a pesquisa destaca a fundamentação da jurisprudência que trata da tutela do direito fundamental à acessibilidade. Inicia-se mediante abordagem geral da teoria dos direitos fundamentais, passando, após o destaque da decisão judicial, ao estudo específico acerca da identificação, aplicação, conceito e classificação do direito fundamental à acessibilidade bem como sua regulamentação legal. Ao fim, a conclusão apresenta a síntese do tema comentando se a decisão judicial em enfoque promoveu a devida proteção aos direitos fundamentais dos interessados envolvidos |
