| Spanish abstract | El presente artículo tiene como objetivo último exponer los fundamentos jurídicos, sobre la inviabilidad de la estrategia de Bolivia de denunciar el Tratado de 1904 y, a partir de este hecho unilateral, resolver su reivindicación marítima ante la Corte Internacional de Justicia de La Haya (CIJ). Se establecen, a partir de ellos las razones chilenas para sustentar la importancia y vigencia del Tratado de 1904. Por último, se contribuye a esclarecer otros elementos que conformarían el constructo jurídico por lo cual se concluye que se está en presencia de una temática incierta con consecuencias territoriales y soberanas |
| English abstract | The main purpose of this article is to present the legal foundations of the infeasibility of the strategy of Bolivia to denounce the Treaty of 1904, and starting from this, the unilateral move to resolve its maritime claim to the International Court of Justice in The Hague (ICJ). Based on these grounds, the Chilean reasons to support the importance and validity of the Treaty of 1904 can be established. Finally, it helps clarify other elements that make up the legal construct by which we conclude that we are in presence of an uncertain issue with territorial and sovereign consequences |
