| Spanish abstract | La investigación tiene como objetivo analizar la congruencia entre la protección del derecho al medio ambiente sano en Jalisco y su instrumentación respecto al trato fiscal diferenciado de los vehículos automotores híbridos y eléctricos durante 2018. Se empleó la metodología jurídica para interpretar, complementar y aplicar el derecho mediante los métodos sistemático, analítico-sintético y deductivo de las normas fiscales y ambientales del Estado de Jalisco aplicados a través de la técnica de investigación documental. Los resultados muestran una falta de congruencia entre la protección del ambiente y el trato fiscal diferenciado estudiado, pues no cumple con los objetivos de la política ambiental o con la equidad tributaria constitucional. Las implicaciones del estudio están dirigidas a armonizar el derecho humano con la norma sustantiva, la política ambiental y las acciones en materia de vehículos. Se concluye que los estímulos fiscales estudiados son insuficientes para proteger el derecho al medio ambiente |
| English abstract | The aim of this research is to analyze the congruence between the right to a healthy environment protection in Jalisco and the implementation thereof with respect to the differential fiscal treatment of hybrid and electric vehicles during 2018. The legal methodology used was the methodology to interpret, complement and apply law through the systematic, analytical-synthetic and deductive methods of fiscal and environmental regulations in the State of Jalisco applied through the documentary research technique. Results show a lack of congruence between the protection of the right to the healthy environment and the special fiscal treatment herein, since it doesn’t comply with the constitutional principle of tax equity or with environmental policy aims. Research implications aim at harmonizing the human right with substantive rules, the environmental policy and the actions regarding vehicles. It is concluded that fiscal stimuli studied herein are not enough to protect the right to a healthy environment |
