| Spanish abstract | La tutela de los derechos humanos constituye un imperativo en cualquier ordenamiento jurídico. Es fundamento de la sociedad democrática. Los sistemas de garantías han ido evolucionando y se perfeccionan, constituyendo las de carácter jurisdiccional una de las más importantes. Por tanto, la interpretación que realizan los jueces adquiere una relevancia incontestable y la uniformidad de estos criterios, una garantía adicional en la protección de los derechos, lo cual reafirma el valor de la jurisprudencia como fuente. Sin embargo, en determinados contextos, especialmente en el Derecho continental, subsisten problemas en cuanto al reconocimiento de esta fuente y su aportación concreta tanto a la interpretación como a la aplicación del Derecho con criterio de uniformidad, contribuyendo con ello a la seguridad jurídica y a una tutela superior de los derechos. Sobre la relevancia de esta problemática se enfoca el presente artículo, empleando una metodología esencialmente cualitativa, analítica y descriptiva |
| English abstract | The protection of human rights is a necessity in any legal system, as a part of a democratic society. In the evolution of the rights guarantee system, the judicial protection is one of the most important. Therefore, the uniformity into judicial interpretation has become in additional guarantee, considering the value of binding precedent as a source of law. However, in certain contexts as civil law, there are still problems regarding the recognition of this source of law and its specific contribution both to the interpretation and application of the law under uniformity criterio, contributing to legal certainty and a superior protection of rights.
