| English abstract | The following article seeks discuss the paths of political protagonism in the legal field. In particular, it seeks to deepen the variants of the judicial activism. Such activism goes from the denunciation of legal formalism to the “fight against corruption” legitimized in technique and in the autonomy of the law against politics. The analysis is constructed comparatively, from the literature that focuses on this process in the United States and France. From the review of the analysis of judicial activism in this countries, it is attempted to construct a references to discuss the Brazilian case |
| Portuguese abstract | O artigo aborda os caminhos do protagonismo político no campo jurídico. Em especial, busca-se aprofundar as variantes do ativismo político-judicial que transita da denúncia do formalismo jurídico para o “combate à corrupção” legitimado na técnica e na autonomia do direito frente à política. A análise é construída comparativamente, a partir da literatura que enfoca esse processo nos Estados Unidos e na França, tendo por objetivo central a construção de referenciais para a discussão do caso brasileiro |
