| Spanish abstract | El presente artículo tuvo como propósito analizar el tratamiento legal del comercio electrónico en Venezuela. Es una investigación de carácter analítica, exploratoria con diseño documental, bibliográfico, a fin de comprender lo que contempla legalmente el uso de esta modalidad comercial. Entendiendo que toda la información involucrada a las transacciones u operaciones electrónicas es oportuna para realizar las previsiones legislativas por parte de los involucrados, otorgándoles de este modo el poder de decidir lo más importante de acuerdo a sus necesidades. Por lo tanto, se busca por medio de la presente investigación, acercarnos un poco más al fenómeno de estudio y de esta manera poder orientar de alguna forma a los lectores sobre la discrepancia legal que existe en el Estado venezolano respecto a la protección del consumidor en la contratación electrónica, así como también en la responsabilidad que tienen las autoridades para su cumplimiento dentro del marco constitucional. Aunque no es posible crear una ley que contemple todos los vacíos legales que se reflejan dentro del comercio electrónico, de momento, es viable dar algunas recomendaciones para poder aminorar dicha situación otorgando respuestas más alentadoras |
| English abstract | The purpose of this article was to analyze the legal treatment of electronic commerce in Venezuela. It is an analytical, exploratory research with documentary, bibliographic design, in order to understand what the use of this commercial modality legally contemplates. Understanding that all the information involved in electronic transactions or operations is timely to carry out the legislative provisions by those involved, thus granting them the power to decide what is most important according to their needs. Therefore, it is sought through this research, to get a little closer to the phenomenon of study and in this way to be able to guide readers in some way about the legal discrepancy that exists in the Venezuelan State regarding consumer protection in electronic contracting, as well as the responsibility that the authorities have for compliance within the constitutional framework. Although it is not possible to create a law that contemplates all the legal gaps that are reflected within electronic commerce, at the moment, it is feasible to give some recommendations in order to lessen this situation by giving more encouraging responses |
