| Spanish abstract | Analizar las fortalezas que tiene la legislación archivística cubana, como garante de la protección de los documentos en cualquier soporte, en relación con los documentos digitales. Los avances de las tecnologías de la información generan nuevos soportes documentales. Ello tiene incidencia en la manera de percibir los sistemas de protección jurídica que recaen sobre este bien tan importante en la gestión administrativa hoy. Las empleadas fueron las relativas al teórico-jurídico, analítico-deductivo y técnica análisis de documentos jurídico. Se obtiene un análisis especifico relativo a las fortalezas que tiene la legislación archivística cubana para proteger los documentos digitales con un enfoque holístico del tema. Los documentos digitales son parte indisoluble del Patrimonio Documental. Cuba posee el cuerpo legal en materia archivística más contemporáneo del área latinoamericana. El enfoque constitucional dado a la concepción del documento digital, desde una perspectiva social, favorece cualquier regulación al respecto. Los antecedentes legislativos en materia de archivos, regulan el bien documentos digitales de una manera general lo que propicia a la gestión y acceso a estos documentos. La legislación Archivística vigente regula el documento digital desde una perspectiva más dinámica y contemporánea. Se propicia un análisis jurídico de un aspecto contemporáneo archivístico como es el tema digital, con un enfoque multidisciplinario desde una perspectiva integral y holístico del tema |
| English abstract | To analyze the strengths of the Cuban archival legislation, as a guarantor of the protection of documents in any medium, in relation to digital documents. Advances in information technology generate new documentary supports. This has an impact on the way of perceiving the legal protection systems that fall on this asset that is so important in administrative management today. Methodology: the ones used were those related to the theoretical-legal, analytical-deductive and technical analysis of legal documents. Results/Discussion: a specific analysis is obtained regarding the strengths of Cuban archival legislation to protect digital documents with a holistic approach to the subject. Conclusions: Digital documents are an inseparable part of Documentary Heritage. Cuba has the most contemporary legal body on archival matters in the Latin American area. The constitutional approach given to the conception of the digital document, from a social perspective, favors any regulation in this regard. Legislative antecedents regarding archives regulate digital documents in a general way, which favors the management and access to these documents. The current Archival legislation regulates the digital document from a more dynamic and contemporary perspective. Originality/Value: a legal analysis of a contemporary archival aspect such as the digital issue is encouraged, with a multidisciplinary approach from an integral and holistic perspective of the subject |
