| Spanish abstract | Las leyes complementan los documentos internacionales para conservar el patrimonio inmueble, por lo que determinar sus antecedentes históricos y las peculiaridades de aplicación en La Habana constituyen objetivos de la investigación. Se examinan los antecedentes de la legislación1 colonial hispana que regulaba la construcción inmueble y la protección del patrimonio cultural edificado. Se rastrean los instrumentos jurídicos que se han aplicado en Cuba. Se discute la legislación vigente, así como el sistema de control orientado a identificar las características y dificultades para conservar el patrimonio edificado de La Habana. Diversos aspectos de las leyes deben ser revisados y modificados. Se concluye en la necesidad de actualizar la legislación vigente y que sus términos garanticen la protección eficaz y conservación del patrimonio inmueble de la ciudad |
| English abstract | Laws have supplemented international documents in order to preserve the cultural heritage. The research objectives of this paper are to determine their historical antecedents and the unique features of applying those laws in Havana. It begins with a review of the Hispanic colonial laws concerned with building construction and protecting buildings of cultural value. It also reviews the legal instruments that protect seminal buildings of Havana. A discussion of the characteristics and weaknesses of the Cuban laws today reveals difficulties of facing the built heritage conservation in Havana. Several aspects of the law should be revised and modified. The paper concludes with recommendations about the need for improving laws that guarantee the effective protection and conservation of the city’s built heritage |
