| Spanish abstract | El autor plantea que inicialmente, en la sentencia de excepciones preliminares del caso Las Palmeras contra Colombia, la Corte Interamericana de Derechos Humanos se apegó al principio de competencias de atribución, para estimarse incompetente para declarar responsable a un Estado parte en la Convención Americana sobre Derechos Humanos por violar normas y principios del derecho internacional humanitario. Si bien expresamente en faltos posteriores no ha manifestado un cambio jurisprudencial en la materia, en la práctica, éste ha venido sucediendo, por la vía de la interpretación sistemática del Pacto de San José con otros instrumentos internacionales, entre ellos, el Protocolo II de Ginebra de 1977, merced al recurso a la Convención de Viena sobre Derecho de los Tratados y a diversas cláusulas de reenvío que contiene la Convención Americana |
| English abstract | The author establishes that in the sentence of preliminary exceptions of the case Las Palmeras vs. Colombia, the Interamerican Court of Human Rights decided in accordance to the principle of attribution of competences. This way it proclaims itself incompetent to declare the responsibility of a State part of the American Convention on Human Rights for violating norms and principles of the humanitarian international law. Even if in the subsequent resolutions a change in the jurisprudence has not been manifested, in practice, it has been develop tng trough the systematic interpretation of different international instruments such as the American Convention of Human Rights, Protocol II of the Geneva Conventions 1977, Viena Convention on the Law of Treaties and a couple of clauses included in the American Convention |
