| Spanish abstract | El artículo presenta una fundamentación de los derechos humanos desde la filosofía vitalista del pensador colombiano Darío Botero Uribe. Se parte de los antecedentes que desembocaron en la Declaración Universal de Derechos Humanos Adoptada y proclamada por la Asamblea General en su resolución 217 A (III), de 10 de diciembre de 1948, se discuten algunos aspectos de la fundamentación del derecho natural y del derecho positivo, y se concluye recalcando que la vida es la condición de posibilidad de los demás derechos; sin embargo, no cualquier vida, sino una vida digna en que no se prescinde de algunos consensos mínimos que permitan la convivencia de la pluralidad en un mundo que tiene un destino común, un destino que nos afecta radicalmente a todos |
| English abstract | The article presents a foundation of human rights based on the vitalist philosophy of the Colombian thinker Darío Botero Uribe. Starting from the background that led to the Universal Declaration of Human Rights adopted and proclaimed by the General Assembly in its resolution 217 A (III), of December 10, 1948, some aspects of the foundation of natural law and positive law are discussed. It is concluded that life is the condition of possibility of the other rights, yet, not just any life, but a dignified one that does not dispense with some minimum consensus that allows the coexistence of plurality in a world that has a common destiny, which radically affects us all |
