| Spanish abstract | Considerando que en la primera parte de este ensayo se analizó la importancia de los hechos, el contexto y el lenguaje en el proceso de construcción de la sentencia ‘‘Granier y otros (Radio Caracas Televisión) vs. Venezuela’’, en esta ocasión se profundiza en la fundamentación estrictamente jurídica de la resolución de la controversia. El abordaje se platea desde una perspectiva crítica e interna, desde la cual se fiscaliza el paradigma y la estructura de la decisión. Como resultado, se consideran posibles contradicciones, oscuridades e imprecisiones al interior de la cadena de argumentación, sin recurrir a posibles apreciaciones respecto de su justificación externa. Finalmente, se examinan las consecuencias jurídicas que podrían desprenderse como normas adscriptas a los derechos de libertad de expresión, libertad de imprenta y propiedad privada |
| English abstract | In the first part, we analyzed the importance of the facts, the context and the language in the process of construction of the sentence “Granier and others (Radio Caracas Television) vs. Venezuela’’, on this occasion, the strictly legal basis for the resolution of the dispute is considered. The approach is based on a critical and internal perspective, from which the paradigm and the structure of the decision are scrutinized. As a result, possible contradictions, obscurities and inaccuracies are examined within the chain of argument, without resorting to possible judgments regarding its external justification. Finally, legal consequences that could emerge as norms attached to the rights of Freedom of Expression, Freedom of Printing and Property are evaluated |
