| English abstract | This article makes a holistic analysis of the foundations and transformation of the concept of Peace in the light of human rights in general and collective rights in particular. It analyzes the historical mutation offered by two concepts, starting from the pacification of territories, with a view to the imposition of a hegemonic type of order, to territorial peace, which is exposed as an antithesis or counter-hegemonic element, leaving in evidence the clear symbiotic participation between the concept of peace, territory, human rights with a vision of enjoyment in collective essence. Current socio-legal phenomena are contrasted in the current Colombian post-agreement spectrum, together with dogmatic and phenomenological elements of historical character that expose the heterotopic and counter-hegemonic quality of human rights in Colombia. |
| Spanish abstract | En este artículo se hace un análisis holístico de los fundamentos y la transformación del concepto de paz a la luz de los derechos humanos, en general, y de los derechos colectivos, en particular, para entender la mutación histórica a partir de dos conceptos: la pacificación de los territorios, con miras a la imposición de un orden de tipo hegemónico, y la paz territorial, que se expone como antítesis o elemento contrahegemónico, dejando en evidencia la clara participación simbiótica entre el concepto de paz, el territorio y los DDHH, con una visión de disfrute en esencia colectiva. Se contrastan fenómenos socio-jurídicos en el espectro colombiano actual del posacuerdo, junto con elementos dogmáticos y fenomenológicos de carácter histórico, que exponen como resultado la calidad heterotópica y contrahegemónica de los derechos humanos en Colombia, revestidos de una nueva fundamentación. |
