| Spanish abstract | La relación entre el derecho y la literatura tiene diversas formas, pero rara vez se menciona el modo en que el derecho contribuyó a la formación de la novela moderna. Como muestra este ensayo, ello fue posible porque la codificación del derecho romano realizada por Justiniano fue apropiada por Boccaccio, quien, a su vez, codificó la novela. La codificación le permitió reunir un conjunto heterogéneo de relatos bajo un potente marco articulador. Pero, además, como se mostrará en estas páginas, el término mismo de “novela” proviene también de Justiniano, pues así tituló su trabajo legislativo posterior a sus Constituciones |
| English abstract | The relationship between law and literature takes various forms, but the way in which law contributed to the formation of the modern novel is rarely mentioned. As this essay shows, this was possible because Justinian’s codification of Roman law was appropriated by Boccaccio, who, in turn, codified the novel. Coding allowed him to gather a heterogeneous set of stories under a powerful articulating framework. But in addition, as will be shown in these pages, the very term “novel” also comes from Justinian, since that is how he titled his legislative work after his Constitutions |
