| Spanish abstract | El presente trabajo trata de aclarar el significado de la noción de "principio jurídico", que no ha sido utilizada siempre en el mismo sentido por diversos autores "neoconstitucionalistas". Así mismo, se ha procurado efectuar una distinción entre el significado que el término posee en el neoconstitucionalismo, y la noción de "principia iuris", tal como era conocida en el Derecho romano. A juicio del autor, una distinción entre ambos términos, el moderno y el romanista, tiene que ver con una división más profunda que cabe efectuar entre entendimiento teórico y entendimiento práctico |
| English abstract | This paper seeks to clarify the notion’s meaning of "legal principle", which has not been used always in the same way by different "neoconstitutionalist" authors. Also, it has sought to establish a difference between the meaning given to the term in neoconstitutionalism, and the notion of "principia iuris", as it was known in Roman law. For the author, a distinction between the two terms, the Modern and the Roman, has to do with a deeper division that could be made between theoretical and practical understanding |
