| Resumen en inglés | This article is concerned with the human rights and their basis. It is argued that such human rights are a concept built in human recent History, as those in the Christian Doctrine, in the Illuminism and in the Kantianism. Therefore, it aims to show some basic structures of Law, in the light of the International Law – Human Rights, foreseen in the Federal Constitution – Fundamental Rights, and Civil Law – Personality Rights. The legal analysis will be based on Portuguese and – to a lesser degree – on German law. Based on the conclusions from the results found, this paper fi nally shall suggest an approach for a private law |
| Resumen en portugués | Este trabalho aborda a construção histórica dos direitos humanos e sua fundamentação, ou seja, o Cristianismo, o Iluminismo e a abordagem de Kant. Analisa as diversas abordagens: o Direito Internacional e os Direitos Humanos, a Constituição e os Direitos Fundamentais, e o Direito Civil e os Direitos de Personalidade, com base no Direito Português e, em menor escala, o Direito Alemão.
