| Resumen en inglés | It is considered proof every element that can take to someone the knowledge of a fact to someone. In the process, it defines every means taken to convince the judge regarding the occurrence of a fact. The Federal Constitution foresees certain rights and basic guarantees that interfere in the approbatory amplitude. It states that within the process it is inadmissible any proof acquired through illicit ways. However, it is certain that, depending on the interests in litigation, a constitutional guarantee may conflict with another and, in this case, the judge might soften such rules, analyzing the right of each part. The judgment must be carried quickly and efficiently and be kept as faithful and similar to the one that there was before the breaking of the norm. | Resumen en portugués | Prova é todo elemento que pode levar o conhecimento de um fato a alguém. No processo, significa todo meio destinado a convencer o juízo a respeito da ocorrência de um fato. A Constituição Federal prevê certos direitos e garantias fundamentais que interferem na amplitude probatória. Preceitua que são inadmissíveis, no processo, as provas obtidas por meios ilícitos. Contudo, é certo que, dependendo dos interesses em litígio, uma garantia constitucional pode conflitar com outra, podendo o juiz flexibilizar tais regras, analisando o direito de cada parte. A prestação jurisdicional deve ser exercida de modo eficaz e célere, o quanto possível, de maneira mais fiel e próxima àquela existente antes da violação da norma.
