| Resumen en inglés | The purpose of this study is to analyse the restrictions of the fundamental rights, even though those limitations that are recognized by the Brazilian Constitution, when the Constitutional Law imposes the restrictions directly, indirectly or even in a tacit way. There are some real situations which must be solved by the juridical system, and from this view, the judge should provide the harmonization of the fundamental rights in order to minimize the restrictions for any one of them. It becomes necessary to make an approach about the boundaries of these restrictions, for this reason this work shows some real cases for a better understanding |
| Resumen en portugués | Trata o presente estudo das restrições aos direitos fundamentais, reconhecendo-se a limitação destes, principalmente quando a ordem constitucional impõe restrições direta, indireta ou tacitamente, ou ainda, quando em casos concretos, o judiciário é chamado a harmonizar direitos fundamentais sopesando direitos em confronto, de forma a minimizar a restrição a qualquer um deles. Abordam-se os limites das restrições aos direitos fundamentais, trazendo-se exemplos de alguns casos concretos para melhor entendimento |
