| Resumen en inglés | This essay begins with a brief examination of the inclusion of fundamental human rights in the Constitution of 1988, the generations or dimensions of rights consecrated in the constitutional text and finally, of the nature of the constitutional rules that create rights. After that this essay develops an analysis of the referring constitutional municipal abilities about human fundamental rights of first, second and third generations, taking as starting point the distribution of abilities established in the Constitution of 1988. It also approaches, briefly, some instruments that allow to the effectiveness and the accomplishment of rights in the municipal level |
| Resumen en portugués | O texto, de início, introduz breve exame sobre a positivação dos direitos humanos fundamentais na Constituição de 1988, as gerações ou dimensões de direitos consagradas no texto constitucional e a natureza das normas constitucionais instituidoras de direitos. Após, o trabalho desenvolve uma análise das competências constitucionais municipais referentes aos direitos fundamentais de primeira, segunda e terceira geração, tomando como ponto de partida a repartição de competências estabelecida na Constituição de 1988.
