| Resumen en español | El texto tiene como tesis principal “las paradojas del derecho de asociación en España: la reiteración en ciertas especies asociativas de normaciones preconstitucionales por el legislador preconstitucional y la dualidad de interpretaciones, flagrantemente contradictorias del juez constitucional, en función del carácter “PRE” o “POST” constitucional de la normación”. El trabajo desenvuelve el tema analizando, en la Constitución Española, en la legislación y en la jurisprudencia del Tribunal Constitucional el derecho de asociación, la libertad negativa de asociación y la adscripción obligatoria a los entes públicos asociativos y el régimen de constitución y de adquisición de personalidad jurídica de los partidos políticos |
| Resumen en inglés | The text has as it main thesis “the paradoxes of the right of association in Spain: the reiteration in certain associative species of pre-constitutionals norms by the pre-constitutional legislator and the duality of interpretations, flagrantly contradictory from the constitutional judges, based on the character “PRE” or “POST” constitutional of the “norms”. The work develops the subject analyzing, in the Spanish Constitution, in the legislation and in the jurisprudence of the Constitutional Court the right of association, the negative freedom of association and the obligatory allegiance to the associative public beings and the regime of constitution and acquisition of legal personality of the parties |
