| Resumen en inglés | The Federal Court of Administrative Justice can hear about the Traditional Trial, the Summary Judgment, the Online Trial and now the Judgment on the Exclusive Resolution of the Merits. The justification of the latter is the immediate attention of the most relevant issues that may result in the annulment of the contested act. Thus, the Judgment on the Exclusive Resolution of the Merits attempts to be an effective means of resolving administrative disputes, including those aimed at orality. However, as any procedural innovation is questionable, therefore, this article tries to establish certain bases that allow for its analysis and propositional criticism, in order to grant the administered, the broadest protection of their rights. |
| Resumen en español | El Tribunal Federal de Justicia Administrativa puede conocer del Juicio Tradicional, del Juicio Sumario, del Juicio en Línea y ahora del Juicio de Resolución Exclusiva de Fondo. La justificación de este último es la atención inmediata de las cuestiones de mayor relevancia que puedan generar la nulidad del acto impugnado. Es así que el Juicio de Resolución Exclusiva de Fondo intenta ser un medio eficaz de solución de controversias administrativas, incluso tendientes a la oralidad. No obstante, como cualquier innovación procesal resulta cuestionable. Por tanto, este artículo intenta establecer ciertas bases que permitan su análisis y crítica propositiva, a fin de conceder a los administrados, la protección más amplia de sus derechos. |
